To minimize the risk of a claim and protect a firm’s assets and profits, it is important for accountants and bookkeepers to understand the basis of their legal liability which includes the elements required to prove professional negligence. There are also other basis for legal liability including duties under contract, fiduciary duties, and state and federal law requirements that should be understood and the use of professional liability claim statistics, claim examples, and claim trends can illustrate many of these obligations. In addition to understanding the basis of legal liability, it is important to understand the potential damages an accountant or bookkeeper can be responsible for as well as defense strategies that may be available. |
